1.2. Please read these Terms carefully before using FemPhases. They explain what you can expect from us, what we expect from you, how paid services work, and how issues may be handled if something goes wrong.

1.3. By creating an account, accessing the website, downloading the app, or using any FemPhases feature, you confirm that you accept these Terms.

1.4. If you do not agree to these Terms, you must not access or use FemPhases.

2. Who we are

2.1. FemPhases is a digital platform offering menstrual-health, cycle-tracking, symptom-logging, fertility-awareness, well-being, and related informational services.

3.3. Additional terms may apply to specific features, offers, promotions, or third-party integrations. Where they do, those terms will apply alongside these Terms.

4. Who can use FemPhases

4.1. You may only use FemPhases if you are legally capable of entering into a binding agreement and meet any minimum age requirement set by FemPhases.

4.2. If FemPhases sets a minimum age, that age requirement must be followed across the app, website, sign-up process, and related policies.

4.3. If you use FemPhases on behalf of an organisation, you confirm that you have the authority to bind that organisation to these Terms.

4.4. We may restrict certain features based on age, location, or legal requirements.

5. Medical disclaimer

5.1. FemPhases is not a medical provider. It does not provide diagnosis, treatment, emergency care, or personalised clinical advice.

5.2. Any information, reminders, charts, summaries, cycle predictions, fertility estimates, symptom insights, educational materials, or other content made available through FemPhases is for general information and self-management support only.

5.3. FemPhases should not be used as a substitute for advice from a doctor, nurse, pharmacist, midwife, or other qualified healthcare professional.

5.4. You should seek appropriate professional advice if you have concerns about your health, symptoms, fertility, pregnancy, contraception, medication, or any urgent or worsening condition.

5.5. If you believe you may have a medical emergency, contact emergency services or seek urgent medical care immediately.

6. Your account

6.1. Some FemPhases features require you to create an account.

6.2. You agree to provide accurate, complete, and up-to-date information and to update it if it changes.

6.3. You are responsible for maintaining the confidentiality of your login credentials and for activity that occurs through your account unless caused by our failure to take reasonable steps.

6.4. You must notify us promptly if you suspect unauthorised access to your account or any security breach.

6.5. You must not impersonate another person, create an account using false information, or attempt to gain access to another person’s account.

7. Your use of FemPhases

7.1. You must use FemPhases lawfully, responsibly, and in accordance with these Terms.

7.2. You are responsible for your use of the platform and for any content or information you submit through it.

7.3. You must comply with applicable laws, regulations, and relevant platform rules when using FemPhases.

7.4. You must not use FemPhases in a way that could damage the service, interfere with other users, or create legal, technical, or security risks.

8. Restricted and prohibited conduct

8.1. Unless the law permits it, you must not:

a. copy, scrape, republish, or extract substantial parts of FemPhases’ content or data;

b. reverse engineer, decompile, disassemble, or attempt to discover source code;

c. modify, adapt, or create derivative works from our software or content without permission;

d. use bots, scripts, crawlers, or automated tools to access or monitor the service without authorisation;

e. interfere with security features, technical protections, or access controls;

f. upload malware, malicious code, or harmful material;

g. use FemPhases for unlawful, misleading, abusive, exploitative, or harmful purposes;

h. harass, threaten, deceive, or endanger other users;

i. use FemPhases to provide unqualified medical advice or harmful misinformation;

j. resell, sublicense, rent, lease, or commercially exploit FemPhases without written consent.

8.2. Any misuse may result in suspension, restriction, or termination of access.

9. Health tracking, predictions, and insights

9.1. FemPhases may allow you to log cycle, symptom, fertility, pregnancy, well-being, or related information.

9.2. FemPhases may generate period predictions, fertility windows, reminders, pattern summaries, or similar outputs based on the information available to it.

9.3. These outputs are estimates only. They are not guaranteed and may be affected by incomplete data, irregular cycles, medical conditions, medications, syncing issues, or other variables.

9.4. You remain responsible for decisions you make about your health, fertility, contraception, pregnancy, and treatment.

10. Third-party integrations and links

10.1. FemPhases may integrate with or link to third-party services, including app stores, payment providers, wearables, health-data tools, analytics providers, or external websites.

10.2. If you connect a third-party platform, you authorise FemPhases to receive the categories of data you choose to share through that platform.

10.3. Third-party services operate under their own terms and privacy policies. FemPhases is not responsible for the content, operation, availability, accuracy, or data-handling practices of any third-party services.

10.4. Your use of third-party services is at your own risk.

11. User content

11.1. You may be able to upload, submit, store, or create content in FemPhases, including notes, logs, feedback, messages, survey responses, and profile information.

11.2. You retain ownership of content you create.

11.3. By submitting content through FemPhases, you give us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, adapt, and display that content as reasonably necessary to operate the service, provide support, improve functionality, protect users, comply with law, and enforce these Terms.

11.4. You confirm that any content you submit:

a. is accurate to the best of your knowledge;

b. does not infringe another person’s rights;

c. is not unlawful, defamatory, abusive, threatening, or misleading; and

d. does not contain harmful code or material.

11.5. We may remove, restrict, or refuse content that breaches these Terms or creates risk for users or FemPhases.

12. Licence to use FemPhases

12.1. Subject to these Terms, FemPhases grants you a limited, personal, revocable, non-exclusive, non-transferable right to access and use the service for your own non-commercial use.

12.2. This licence does not give you ownership of any software, content, branding, design, or intellectual property forming part of FemPhases.

12.3. FemPhases and its licensors reserve all rights not expressly granted.

13. Subscriptions and paid services

13.1. FemPhases may offer free services, paid subscriptions, premium plans, one-off purchases, promotional offers, or trial access.

13.2. Paid features and pricing will be described at the point of purchase.

13.3. Before purchase, we will aim to make clear the main price, billing frequency where relevant, and the key terms of the offer.

13.4. Some features or content included in a paid plan may change over time as the service develops, improves, or retires certain functions.

13.5. Availability of features may vary by device, region, app-store platform, or version.

14. Billing, renewal, and price changes

14.1. If you purchase a paid FemPhases plan, you agree to pay the charges shown at checkout, including any applicable taxes or fees.

14.2. Recurring plans will renew automatically at the end of each billing period unless cancelled before renewal.

14.3. If you subscribe through Apple App Store, Google Play, or another third party, billing and renewal may be handled by that provider under its own rules.

14.4. If FemPhases changes pricing for future subscription periods, we will provide notice before the new price applies to an existing subscription where required.

14.5. Continued use of a renewed paid plan after a notified price change takes effect will normally mean you accept the updated price, unless you cancel beforehand.

15. Trials, cancellation, and refunds

15.1. We may offer trials or introductory offers. Unless stated otherwise, a trial may convert into a paid subscription at the end of the trial period if not cancelled in time.

15.2. You may cancel a paid FemPhases subscription at any time.

15.3. Cancellation will usually prevent future renewal charges but will not normally end access immediately for any period already paid for. Access will usually continue until the end of the current billing term.

15.4. If you subscribed through a third-party app store, you will usually need to cancel through that store account.

15.5. If you subscribed directly through FemPhases, cancellation should be available through account settings or by contacting support.

15.6. Except where required by law, FemPhases does not generally offer refunds once paid digital services have started.

15.7. Nothing in these Terms removes or limits your statutory rights. If paid digital content or services are faulty, not as described, not fit for purpose where applicable, or not provided with reasonable care and skill, you may have legal remedies under UK consumer law.

15.8. Where digital content is supplied within a statutory cancellation period, cancellation rights may be lost where you have expressly agreed to immediate supply and acknowledged that the right to cancel will end once supply begins.

16. Account deletion

16.1. You may request deletion of your FemPhases account at any time.

16.2. Deleting your account may result in loss of access to logs, saved information, premium features, insights, settings, and connected integrations.

16.3. We may retain certain information where reasonably necessary for legal compliance, fraud prevention, dispute handling, tax, accounting, or security purposes.

17. Intellectual property

17.1. All intellectual property rights in FemPhases, including the website, app, software, content, graphics, databases, design, branding, and service materials, belong to FemPhases or its licensors unless stated otherwise.

17.2. You may not use the FemPhases name, logos, branding, or proprietary materials without prior written permission except where permitted by law.

17.3. Nothing in these Terms transfers ownership of FemPhases’ intellectual property to you.

18. Privacy and data protection

18.1. The FemPhases Privacy Policy also governs your use of FemPhases.

18.2. The Privacy Policy explains how personal data is collected, used, stored, shared, retained, and protected.

18.3. If there is any inconsistency between these Terms and the Privacy Policy on a data-handling issue, the Privacy Policy will generally govern that specific issue.

19. Service availability, maintenance, and updates

19.1. We may update, improve, maintain, suspend, withdraw, or modify FemPhases or any part of it from time to time.

19.2. We do not guarantee that every feature will always be available, uninterrupted, secure, error-free, or compatible with every device, operating system, browser, or third-party platform.

19.3. We may carry out maintenance, upgrades, fixes, or service changes without prior notice where reasonably necessary.

19.4. Where changes materially affect a paid service, applicable consumer-law fairness requirements will continue to apply.

20. Warranties and disclaimers

20.1. To the extent permitted by law, FemPhases is provided on an “as available” and “as is” basis.

20.2. We do not guarantee that the service will always be uninterrupted, secure, accurate, complete, or free from bugs, delays, or harmful components.

20.3. We do not guarantee any particular health, fertility, pregnancy, lifestyle, or well-being outcome from using FemPhases.

20.4. Some jurisdictions do not allow certain exclusions or limitations, so some parts of this section may not apply to you.

21. Liability

21.1. Nothing in these Terms excludes or limits liability for:

a. death or personal injury caused by negligence;

b. fraud or fraudulent misrepresentation; or

c. any liability that cannot lawfully be excluded or limited.

21.2. Subject to that, FemPhases will not be liable for losses that were not reasonably foreseeable.

21.3. To the extent permitted by law, FemPhases is not responsible for loss or damage arising from:

a. your misuse of the service;

b. inaccurate, incomplete, or outdated information entered by you;

c. reliance on general informational content instead of professional medical advice;

d. incompatibility with your device, software, or internet connection;

e. failures or downtime of third-party services, platforms, or integrations;

f. interruption, delay, or technical issues outside our reasonable control.

21.4. Nothing in this section affects your statutory consumer rights.

22. Suspension, termination, and enforcement

22.1. We may suspend, restrict, or terminate access to FemPhases if:

a. you seriously or repeatedly breach these Terms;

b. we reasonably suspect fraud, abuse, unlawful conduct, or a security threat;

c. we are required to do so by law; or

d. continued access would expose FemPhases, users, or third parties to significant risk or harm.

22.2. Where appropriate, we may provide notice and an opportunity to address the issue before permanent termination.

22.3. We may investigate suspected misuse and may remove content, restrict access, close accounts, or report matters to relevant authorities where appropriate.

22.4. You may stop using FemPhases at any time.

23.1. If you have questions, concerns, or complaints about FemPhases, including billing, cancellation, technical access, or paid features, please contact:

24.4. Continued use of FemPhases after the updated Terms take effect will usually mean you accept the revised Terms.

25. Governing law and contact details

25.1. The laws of England and Wales govern these Terms, unless mandatory consumer law in another part of the UK gives you the right to rely on that law instead.

25.2. If you are a consumer living in Scotland or Northern Ireland, you may also have rights to bring proceedings in your home courts, subject to applicable law.
